The Department of Natural Resources and Environment announces the results of inspection of the current status of land use, housing, built works and conditions for transferring land use rights and selling houses at the Office for Rent and High-rise Housing Project invested by Thuy Duong Investment Joint Stock Company in Dong Khe ward, Ngo Quyen district (phase 1).
Pursuant to Article 72 of Decree No. 43/2014/ND-CP dated May 15, 2014 of the Government and Clause 46, Article 2 of Decree No. 01/2017/ND-CP dated January 6, 2017 of the Government stipulating the order and procedures for registration and issuance of Certificates of land use rights, ownership of houses and other attached assets. attached to land for recipients to transfer land use rights, buy houses and construction works in housing development projects;
Considering the proposal of Thuy Duong Investment Joint Stock Company on appraising the conditions for transferring land use rights and selling houses for plot No. 2, lot BT1, plot No. 42, lot 38, townhouse complex 3, plot No. 37, lot 21, townhouse complex 2 under the Project of office area for rent and high-rise housing in Dong Khe ward, Ngo Quyen district and Dong Hai ward. 1, Hai An district in Document No. 06a/2021/CV-TDI dated February 1, 2021.
On February 2, 2021, the Department of Natural Resources and Environment organized with the Department of Finance, Department of Construction, City Tax Department, and Ngo Quyen District People's Committee to inspect records, current status of land use, houses, built works and conditions for transferring land use rights, selling houses at the Office for Rent and High-rise Housing Project invested by Thuy Duong Investment Joint Stock Company in Dong Ward. Khe, Ngo Quyen district for plot number 2, lot BT1, plot number 42, lot 38, townhouse 3, plot number 37, lot 21, townhouse 2 (with attached minutes).
On the basis of the diagram of assets attached to the land and the current status of the project measured and drawn by the Center for Technical, Data - Information for Natural Resources and Environment, the results are compared with the current status of the project at the time of inspection by the Department of Construction, records provided by Thuy Duong Investment Joint Stock Company and the agreed content at the meeting; The Department of Natural Resources and Environment announced the inspection results, specifically as follows:
1. Information about the Project:
Project name: Office area for rent and high-rise housing project.
Investor: Thuy Duong Investment Joint Stock Company.
Location: Dong Khe ward, Ngo Quyen district and Dong Hai 1 ward, Hai An district.
The City People's Committee has allocated land and adjusted the Decision on land allocation and approved specific land prices for Thuy Duong Investment Joint Stock Company to implement the Project of office area for rent and high-rise housing in Decisions: No. 2483/QD-UBND dated December 10, 2009, No. 878/QD-UBND dated June 13, 2011, No. 2391/QD-UBND dated December 28, 2012, No. 3295/QD-UBND dated December 27, 2019.
On September 3, 2014, the People's Committee issued Decision No. 1900/QD-UBND on approving the detailed planning adjustment project at 1/500 scale and promulgating management regulations according to the detailed planning adjustment project at 1/500 scale for office areas for rent and high-rise housing in Dong Khe ward, Ngo Quyen district and Dong Hai 1 ward, Hai An district; The Department of Construction issued Official Dispatch No. 98/SXD-QLQH dated January 21, 2015 on approving the architectural plan of low-rise housing projects (townhouses and villas) under the office rental and high-rise housing project invested by Thuy Duong Investment Joint Stock Company; Accordingly, the project implementation area is 20,421.8 m2, of which the area for investment in construction of 09 villas and 52 apartmentsTownhouses and auxiliary buildings for residential purposes are 8,103.21 m2.
2. Regarding project implementation progress.
Thuy Duong Investment Joint Stock Company has completed investment in infrastructure construction, has completed rough construction and is completing 61 residential houses (including 09 villas and 52 townhouses) including plot number 2, lot BT1, plot number 42, lot 38, townhouse 3, plot number 37, lot 21 townhouse 2. Currently, the Company Planting trees is being done according to planning. After completing the infrastructure, Thuy Duong Investment Joint Stock Company is responsible for handing it over to local management according to regulations.
3. Regarding financial obligations.
According to the opinion of the City Tax Department, up to now, Thuy Duong Investment Joint Stock Company has paid the full amount of land use fees to the state budget and has declared and paid non-agricultural land tax of the Office for Rent and High-rise Housing Project in Dong Khe Ward, Ngo Quyen District and Dong Hai 1 Ward, Hai An District.
4. Regarding conditions for transferring land use rights:
Plot number 2, lot BT1, plot number 42, lot 38, townhouses 3, plot number 37, lot 21, townhouses 2 belong to the Office for Rent and High-rise Housing Project in Dong Khe ward, Ngo Quyen district and Dong Hai 1 ward, Hai An district; Thuy Duong Investment Joint Stock Company has been granted Certificates of land use rights, ownership of houses and other assets attached to land by the Department of Natural Resources and Environment: No. CY 537168 dated December 14, 2020, No. CY 537129 dated December 14, 2020, No. CY 537133 dated December 14, 2020.
According to the provisions of Clause 1, Article 188 of the Land Law, Thuy Duong Investment Joint Stock Company is eligible to transfer land use rights.
5. Regarding the Investor's housing selling conditions.
According to the provisions of Point a, Clause 1, Article 9 of the 2014 Law on Real Estate Business, houses and construction works put into business must meet the following conditions:
– Has registered ownership of houses and constructions attached to land in the land use rights certificate. For existing houses and construction works in real estate investment and business projects, only a certificate of land use rights is required according to the provisions of land law;
– There are no disputes over land use rights, ownership of houses or constructions attached to land;
– Not subject to distraint to ensure judgment enforcement
Results at the time of on-site inspection of plot number 2, lot BT1, plot number 42, lot 38, townhouse 3, plot number 37, lot 21, townhouse 2 of the construction project are guaranteed to follow the detailed planning at a scale of 1/500 approved by a competent state agency.
From the results of inspection of works by the Department of Construction and the above regulations, plot number 2, lot BT1, plot number 42, lot 38, townhouse area 3, plot number 37, lot 21, townhouse area 2 belong to the project of office area for rent and high-rise housing in Dong Khe ward, Ngo Quyen district and Dong Hai 1 ward, Hai An district; Investors are qualified to sell houses.
6. Department of Natural Resources and Environment announces: Thuy Duong Investment Joint Stock Company is qualified to carry out procedures for transferring land use rights and selling houses for plot No. 2, Lot BT1, Plot No. 42, Lot 38, Townhouse 3, Plot No. 37, Lot 21 Townhouse 2 of the Office for Rent and High-Rise Housing Project in Dong Khe Ward, Ngo Quyen District and Dong Hai Ward 1, Hai An District (except for cases Housing buyers are foreign organizations and foreign individuals). It is recommended that Thuy Duong Investment Joint Stock Company go to the Receiving and Returning Results Department of the Department of Natural Resources and Environment to submit documents according to regulations.
