Pursuant to the request of the Ministry of Finance in Official Letter No. 13639/BTC-PC dated August 28, 2026, regarding the implementation of Decree No. 288/2026/ND-CP dated July 21, 2026, amending and supplementing a number of articles of Decree No. 122/2021/ND-CP stipulating administrative penalties in the field of planning and investment, the Department of Finance hereby issues the Plan for propaganda, dissemination, and professional training on the implementation of Decree No. 288/2026/ND-CP dated July 21, 2026, of the Government in Hai Phong City with the following specific contents:
To promptly and fully disseminate the contents of Decree No. 288/2026/ND-CP to civil servants working in business registration and to organizations, individuals, enterprises, cooperatives, and business households in the city, thereby enhancing awareness and compliance with business registration laws.
To fully equip civil servants of the Business Registration and Enterprise Management Division and commune-level business registration agencies with professional knowledge and skills to uniformly and accurately apply new regulations on administrative penalties in the field of planning and investment.
To ensure the synchronized, unified, and proper implementation of the Decree, minimizing errors, complaints, and lawsuits arising during the process of handling administrative violations.
Propaganda, dissemination, and training must be conducted regularly, continuously, with a focus; the content must be practical, and the forms diverse and suitable for each target group.
To clearly define the tasks, progress, and responsibilities of each division, unit, and individual in the implementation process; to ensure completion within the set deadlines.
To regularly monitor, urge, and inspect, promptly resolving difficulties and problems arising during the implementation process.
1.1. Key amendments and supplements of Decree No. 288/2026/ND-CP compared to Decree No. 122/2021/ND-CP are as follows:
Regulations on penalty levels for dishonest or inaccurate declaration of business registration dossiers, branch operation registration, representative office, business location, and other change registration contents (penalty levels from VND 30,000,000 to VND 70,000,000 depending on the act).
Regulations on the obligation to declare and provide information about beneficial owners (BOs) of enterprises, information to identify BOs, and penalties for failure to declare, incomplete or inaccurate declaration (penalty levels from VND 50,000,000 to VND 100,000,000); deadline for supplementing BO information for enterprises established before the effective date of the regulation.
Regulations on the obligation to establish, update, and store member registers, shareholder registers, and related documents; penalties for violations related to document storage and registers (penalty levels from VND 40,000,000 to VND 70,000,000).
Regulations on penalty levels based on the delay in performing procedures for changing business registration contents (categorized by milestones: delayed 01-10 days, 11-30 days, 31-90 days, over 90 days) and penalty levels for failure to report, dishonest or incomplete reporting as required by the business registration agency (from VND 20,000,000 to VND 70,000,000).
Accompanying remedial measures (compulsory notification, supplementation of BO information; compulsory submission of reports, provision of information; compulsory establishment, updating, and storage of member and shareholder registers...) and coercive measures to enforce penalty decisions in accordance with the Law on Handling Administrative Violations, Decree No. 296/2025/ND-CP.
1.2. Authority, order, and procedures for administrative penalties according to new regulations; skills in drafting records, issuing penalty decisions, and applying remedial measures to ensure compliance with the Law on Handling Administrative Violations.
1.3. Professional guidance on reviewing and inspecting business registration dossiers, cooperatives, and business households to detect and prevent violations from the stage of receiving and resolving administrative procedures.
Participate in online or in-person training conferences of the Ministry of Finance (if any).
Publish the contents of Decree No. 288/2026/ND-CP on the website of the Hai Phong City Department of Finance: https://sotc.haiphong.gov.vn/.
Integrate propaganda and dissemination content during the process of receiving and resolving administrative procedures related to business registration, cooperative registration, and business household registration.

Funding for organizing propaganda, dissemination, and training shall be allocated from the regular expenditure budget of the Hai Phong City Department of Finance and other lawful funding sources as prescribed.
To be the focal point, presiding over and advising on the implementation of the Plan; compiling documents, organizing training, synthesizing implementation results, and reporting to the Director of the Department.
To monitor, urge, and guide the People's Committees of communes, wards, and special zones during the implementation process.
To coordinate in allocating funding and facilities for training; to support the publication of propaganda documents on the Department's website.
To coordinate with the Department of Finance in organizing propaganda and disseminating the contents of the Decree to enterprises, cooperatives, and business households in the area.
To report implementation results to the Department of Finance (Business Registration and Enterprise Management Division) before the 10th of each month if administrative penalties arise or upon request.
This is the Plan for propaganda, dissemination, and professional training on the implementation of Decree No. 288/2026/ND-CP in Hai Phong City by the Department of Finance. During the implementation of this Plan, if any specific contents of the Plan need to be amended or supplemented, agencies, localities, and units shall proactively propose and send them to the Department of Finance for synthesis and appropriate adjustment./.
