The Ministry of Industry and Trade has just issued Circular 08/2016/TT-BCT guiding the implementation of a number of Articles of the Border Trade Agreement between The Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic.
This Circular guides the implementation of a number of articles of the Vietnam - Laos Border Trade Agreement regarding the purchase, sale and exchange of goods by border traders and border residents.
The Circular applies to: Border traders are Vietnamese traders who register border trade activities in Vietnam - Laos border provinces according to the order and procedures in this Circular to enjoy preferential policies of the Vietnam - Laos Border Trade Agreement; border residents of Vietnam and residents of border districts of Laos; Vietnamese enterprises investing in production, farming, and planting in Lao provinces bordering Vietnam; Other organizations and individuals related to Vietnam - Laos border trade activities.
According to the Circular, documents and procedures for registering border traders apply according to the provisions of Article 4 of Circular No. 52/2015/TT-BCT of the Minister of Industry and Trade regulating in detail cross-border goods trading activities of traders in Decision No. 52/2015/QD-TTg of the Prime Minister on the management of border trade activities with countries sharing a common border.
Imported goods of border traders are entitled to preferential import tax rates according to Clause 1, Article 6 of the Vietnam - Laos Border Trade Agreement when they have a Certificate of Origin (C/O) form S issued by a competent Lao authority. Border traders importing goods to Vietnam according to the provisions of Article 7 and Clause 2, Article 13 of the Vietnam - Laos Border Trade Agreement, when carrying out import procedures, must have the following documents: a) Confirmation of goods according to the project of the Vietnamese investor issued by the Department of Industry and Trade at the border province or the Department of Industry and Trade at the border district of Laos; b) Confirmation from Lao competent authorities on medical, animal, plant, aquatic quarantine, quality inspection and food safety control.
Border residents according to the provisions of Clause 1, Article 5 of the Vietnam - Laos Border Trade Agreement are allowed to buy, sell, exchange goods and enjoy tax exemption according to the provisions of Decision 52/2015/QD-TTg of the Prime Minister on the management of border trade activities with bordering countries and Circular No. 54/2015/TT-BCT of the Ministry of Industry and Trade regulating the List of goods traded and exchanged. exchange of border residents. Plants, livestock, and goods produced by residents in border districts of Laos enjoy incentives specified in Clause 4, Article 5 of the Vietnam-Laos Border Trade Agreement. When carrying out import procedures, the following documents must be present: a) Confirmation that the goods are produced by residents in border districts of Laos by the Department of Industry and Trade.at the border province level or the Chamber of Industry and Trade at the border district level of Laos; b) Confirmation from Lao competent authorities on medical, animal, plant, aquatic quarantine, quality inspection and food safety control./.
