(Haiphong.gov.vn) – Chairman of the City People's Committee has just Directed requiring Directors of Departments, Chairman of District People's Committees, Directors of Management Boards under the City People's Committee, Heads of relevant agencies and units, State-owned enterprises in the city, Investors to implement projects including public investment, regular procurement using the state budget and land use projects to improve efficiency, Effective implementation of the Bidding Law, strengthening quality management in the selection of contractors and investors in the city.
Review and complete documents directing, administering and guiding the implementation of the Bidding Law
The directive requires the Department of Finance to regularly monitor and guide the implementation of bidding laws to promptly remove difficulties and obstacles and overcome limitations and inadequacies in bidding work in the city. Review documents regulating bidding to select investors to implement projects under management (if any) to promptly issue or report to the City People's Committee to issue documents amending and supplementing, ensuring compliance with the provisions of the Bidding Law, Decree No. 23/2024/ND-CP and the Decree detailing a number of articles and measures to implement the Bidding Law on selecting investors to implement investment projects using land (following when issued).
The Department of Finance reviews and guides the city's regulations on management and use of public assets; Assigning tasks, placing orders, bidding to provide products, public services and other tasks using the state budget from regular expenditure sources to ensure compliance with the Bidding Law, Decree No. 24/2024/ND-CP. Report to the City People's Committee and submit to the City People's Council to issue documents regulating the authority to decide on the procurement of assets, goods and services according to the provisions of Article 91 of Decree No. 24/2024/ND-CP.
The Department of Health reviews detailed regulatory documents issued by the City People's Committee or under the authority of the Department of Health to ensure compliance with the Bidding Law, Decree No. 24/2024/ND-CP. Advise the City People's Committee to promulgate a list of goods and drugs applicable to centralized procurement under the city's management according to the provisions of Point c, Clause 2, Article 53 of the Bidding Law.
Improve the quality and efficiency of bidding activities
Departments, branches, localities, and state-owned enterprises in the area strengthen the application of IT in bidding and selecting contractors and investors, promoting the implementation of online bidding on the National Bidding Network System in accordance with the roadmap prescribed in Decree No. 23/2024/ND-CP and Decree No. 24/2024/ND-CP; Post full information responsibly and within the deadline according to the provisions of the law on bidding on the National Bidding Network System to optimize the selection of contractors and investors online, expanding access to information to potential domestic and international investors.
People's Committees at district and commune levels direct investors, bidding parties, interested parties, and appraisal agencies and units to strictly implement the provisions of law on bidding; In particular, pay attention to speed up the progress of selecting contractors, investors, drafting business investment project contracts in the process of preparing bidding documents, negotiating, signing and implementing contracts.
For contractor selection plans that the person with authority to approve is the Chairman of the City People's Committee, the agency appraising the contractor selection plan according to regulations (including the Department of Finance, the Department of Finance and the Department of Health) is responsible for supervising bidding activities under the responsibility of the competent person as prescribed in Clause 4, Article 86 of the 2023 Bidding Law to ensure the goals of competition, fairness, transparency and economic efficiency.
Departments, branches, localities, and state-owned enterprises in the city will strengthen the organization of regular inspection and examination of bidding work according to regulations. Inspections and tests must ensure requirements and quality, in order to detect limitations, shortcomings and violations. Propose timely remedial measures; At the same time, strengthen the role of inspection, examination and supervision agencies to implement inspection conclusions and handle violations according to their authority. Inspection and examination agencies must ensure that they carry out their tasks fairly and objectively, and do not let inspection and examination affect, interrupt or delay bidding and procurement activities at medical facilities.
Strengthen the organization of inspection and examination of bidding implementation
To strengthen quality management in the selection of contractors and investors in the city, the Directive requires focusing on implementing the selection of contractors and investors in accordance with the provisions of law, especially contractors in important and key projects to accelerate the progress of projects and promote the disbursement of public investment capital.
Improve the quality of investment preparation (project formulation, appraisal, approval), ensuring the project is feasible and attractive to many investors so that public bidding can be organized. Carrying out investor selection for investment projects using land, the project must organize bidding to select investors according to the provisions of specialized laws and fields to ensure competitiveness, transparency and economic efficiency.
Agencies and units with the function of proactive inspection and testing, strengthening specialized inspections on bidding (not integrated into other inspections) and supervising the implementation of inspection conclusions, especially handling violations; Focus on inspecting bidding packages with few participating contractors, low savings value, large-scale and complex bidding packages, bidding packages without online bidding, bidding packages using direct contractor designation that do not comply with the law on bidding, or bidding packages with many petitions, complaints, and denunciations, and at the same time, take strict measures to handle cases where inspection conclusions are not implemented or violations continue to occur.
In addition, it is necessary to strengthen and diversify propaganda and dissemination of legal regulations on bidding and selecting contractors and investors (especially on online bidding); Pay attention to and create conditions for individuals from expert groups and appraisal teams to participate in knowledge training courses and take exams to grant professional certificates in bidding to improve capacity and professionalism, standardize the quality of staff working in bidding, and ensure they have enough qualifications and experience to meet the requirements of bidding packages and projects./.
