The Ministry of Planning and Investment has just issued Circular 02/2016/TT-BKHDT guiding the preliminary selection of projects projects, prepare, evaluate, and approve project proposals and research reportsFeasibility of investment projects in the form of public-private partnership (PPP).
This Circular guides the preliminary selection of projects; prepare, evaluate and approve project proposals; Prepare, appraise and approve feasibility study reports for investment projects in the form of public-private partnerships within the scope of regulation specified in Article 1 of Decree No. 15/2015/ND-CP of the Government on investment in the form of public-private partnership.
Accordingly, the preliminary selection of projects aims to correctly identify infrastructure projects, providing equipment and public services that are studied for investment in the form of PPP. The project is preliminarily selected to ensure it meets the prescribed criteria.
Preliminarily selected projects must fully meet the following criteria: In accordance with planning, industry and regional development plans and local socio-economic development plans; in accordance with the investment field specified in Article 4 of Decree 15/2015/ND-CP and is a priority project of the Ministry, ministerial-level agencies, and provincial-level People's Committees; Able to generate revenue to return capital to investors, prioritizing projects that generate revenue from business activities.
In addition to the criteria specified above, based on the level of information of each project, the following additional criteria can be considered to prioritize preliminary project selection: There are interested investors; there is a great need to use the service; There are favorable factors for investment implementation (the project has completed site clearance; auxiliary and connection works have been built; raw materials, machinery and technology are available on the market).
For the preparation, appraisal and approval of feasibility study reports, the Circular clearly states that the project preparation unit or investor is assigned the task of preparing a feasibility study report according to the provisions of Clause 1, Article 25 of Decree No. 15/2015/ND-CP.
The project preparation unit or investor assigned to prepare a feasibility study report shall submit to the Ministry, ministerial-level agencies and the Provincial People's Committee 01 set of documents to submit for approval of the feasibility study report; At the same time, send the appraisal unit 04 sets of documents to submit for approval of the feasibility study report.
Regarding approval of the feasibility study report, based on the dossier submitted for approval of the feasibility study report by the project preparation unit or investor and the appraisal dossier of the appraisal unit, the Minister, Heads of ministerial-level agencies and Chairman of the Provincial People's Committee approve the feasibility study report.
The decision to approve the feasibility study report includes the following basic contents: Project name; name of the state agency competent to sign the contract with the investor; name of the project preparation unit or investor assigned to prepare the feasibility study report; location, scale, project capacity, land use area; detailed technical requirements; total investment capital; State investment capital participating in project implementation (if any); type of project contract; financial plan; project contract period; Investment incentives and guarantees…
This Circular takes effect from April 18, 2016./.
