The Government has just issued Decree No. 120/2014/ND-CP amending and supplementing a number of articles of Decree No. 133/2008/ND-CP dated December 31, 2008 of the Government detailing and guiding the implementation of a number of articles of the Law on Technology Transfer.
Specifically, according to the provisions of Decree No. 133/2008/ND-CP, there are 11 technologies that are restricted from being transferred from foreign countries to Vietnam and within the Vietnamese territory. But according to the new regulations, up to 23 technologies are restricted from being transferred from abroad to Vietnam and within Vietnamese territory.
Including technology for producing industrial explosives; technology for producing construction materials using chrysotile; Titanium oxide powder production technology using sulfuric acid; Technology for using toxic chemicals in aquaculture, cultivation and processing...
The new Decree also amends and supplements the List of technologies prohibited from transfer. Accordingly, there are 30 technologies banned from being transferred from abroad to Vietnam and within Vietnamese territory. This includes technology that disables devices that measure, count, and calculate the amount of electricity used; vertical kiln cement production technology; Technology for producing forest product preservatives containing Pentachlorophenol (PCP), DDT...
The new Decree also clearly states that the import, transfer and use of technology on the List of technologies prohibited from transfer for special scientific research and technology development purposes is decided by the Prime Minister.
The new Decree takes effect from February 1, 2015. Clause 1, Article 5 and 3 of the Technology List of Decree No. 133/2008/ND-CP are annulled from the effective date of Decree 120/2014/ND-CP.
