Pursuant to the Law on Promulgation of Legal Documents, the Department of Finance has organized to collect opinions and social criticism on the draft Decision stipulating the authority to approve policies and estimate funding and costs to carry out a number of tasks from the regular expenditure source of Hai Phong city budget.

The head of the budget-using unit decides to use funds for implementing financial autonomy in accordance with the provisions of law."
2	Article 1. Scope of adjustment	People's Committee of Nguyen Binh Khiem commune (Official Dispatch No. 964/UBND-KT dated May 21, 2026)	It is recommended to clarify the content of "new construction of work items in projects that have been invested in construction" and "planning activities using regular expenditures" in Clause 1, Article 1 to facilitate localities in the process of determining implementation tasks, avoiding overlap with the field of public investment.	Remain as draft. 3	Article 1. Scope of adjustment	People's Committee of Nguyen Binh Khiem commune (Official Dispatch No. 964/UBND-KT dated May 21, 2026)	It is recommended to provide specific guidance on cases falling within the scope of "recurring expenditure estimate allocation norms assigned by competent authorities" in Clause 2, Article 1 to facilitate the commune level in determining cases where policies must be submitted for approval and cases in which they can be proactively implemented according to estimates assigned at the beginning of the year.	The guidance is not implemented in the Decision because this is a legal document that specifically regulates authority. However, to facilitate the process of amending Clause 2, Article 1 as follows: “2. This decision does not apply to regular expenditure estimates for implementing financial autonomy according to the allocation norms of state budget regular expenditure estimates. Heads of budget-using units decide to use funds for implementing financial autonomy in accordance with the provisions of law."
4	Article 2. Subjects of application	Vietnam Fatherland Front Committee of the city (Official Dispatch No. 704/MTTQ-BTT dated May 26, 2026)	Recommended to add additional subjects "City Vietnam Fatherland Front Committee" to ensure subjects as prescribed in Article 2 of Decree No. 104/2026/ND-CP dated March 31, 2026 of the Government	Accept and amend Article 2 as follows: *“Article 2. Subjects of application* 1. Subjects of application	Department of Justice (Official Dispatch No. 2551/STP-XDVB dated June 4, 2026)	It is recommended to re-arrange Article 2 of the draft to make it clearer and more appropriate “*Article 2. Subjects of application‎ 1. Agencies and units include:‎* a) State agencies, political organizations and socio-political organizations.‎ b) Public service units.‎ 2. 6	Article 2. Subjects of application	Department of Science and Technology (Official Dispatch No. 2085 dated May 26, 2026)	It is proposed to omit Clause 4, Article 2 "The subjects specified in Clauses 1, 2 and 3 of this Article, hereinafter collectively referred to as agencies and units" because it is not consistent with the content of the draft Decision.	Accepted and deleted Clause 4, Article 2.
7	Article 3. Authority to decide on approval of policies and estimated funding for procurement, repair, renovation and upgrading of assets and equipment	Department of Science and Technology (Official Dispatch No. 2085 dated May 26, 2026)	It is proposed to omit the regulation “after obtaining the written consent of the Chairman of the City People's Committee” in Clause 2, Article 3 of the draft Decision in order to reduce the time to carry out the procedures for deciding on policy approval and estimated funding for purchasing, repairing, renovating and upgrading assets and equipment; At the same time, it is consistent with the regulations on the responsibilities of the competent decision-making authority (after decentralization) in Clause 4, Article 17 of Decree No. 104/2026/ND-CP. 8	Article 3. Authority to decide on approval of policies and estimated funding for procurement, repair, renovation and upgrading of assets and equipment	Department of Agriculture and Environment (Official Dispatch No. 5885/SNNMT-TCKHDT dated May 25, 2026)	The drafting agency is requested to remove the phrase “…, after receiving written consent from the Chairman of the City People's Committee, …” in Clause 2, Article 3 of the draft. 9	Article 3. Authority to decide on approval of policies and estimated funding for procurement, repair, renovation and upgrading of assets and equipment	Department of Agriculture and Environment (Official Dispatch No. 5885/SNNMT-TCKHDT dated May 25, 2026)	Recommended to study more authority for: Heads of budget-using units to decide to approve policies and estimated funding for purchasing, repairing, renovating and upgrading assets and equipment using provincial budget.	Remain as draft. Reason: The head of the budget-using unit can decide to use the funds in the recurrent expenditure estimate with financial autonomy, as stipulated in Clause 2, Article 1. In this Draft, the City People's Committee only stipulates the authority of the immediate subordinate heads, which are the Head of the provincial budget level I estimate unit and the Chairman of the Commune People's Committee to be consistent with the responsibility of synthesizing estimates and allocating and assigning estimates to affiliated budget-using units according to the provisions of the 2025 State Budget Law.

11	Article 3. 13	Article 3. 14	Article 3. Authority to decide on approval of policies and estimated funding for procurement, repair, renovation and upgrading of assets and equipment	Ward People's Committee Thanh Dong (Document No. 1214/UBND-KTHTĐT dated June 1, 2026)	In Clause 3, Article 3, it is recommended to study and supplement specific instructions on the order, records and responsibilities of specialized agencies in the appraisal and approval process to facilitate localities when implementing.	The Department of Finance will advise the City People's Committee to issue documents directing implementation.
15	Article 3. Authority to decide on approval of policies and estimated funding for procurement, repair, renovation and upgrading of assets and equipment	People's Committee of Kien Hung commune (Official Dispatch No. 1566/UBND-KT dated May 26, 2026)	To create proactive and timely resolution of urgent situations at the commune level in managing, operating and accelerating the disbursement of capital resources, it is recommended that the authorities consider decentralizing the tasks of using targeted additional sources from the superior budget to the commune-level budget to the commune level with the following contents: + Authority to decide on approving policies and estimated funding for asset procurement, upgrading assets and equipment from additional sources with upper level budget targets valued at < 500 million VND.	Accept and amend Clause 3, Article 3 as follows: “3. The Chairman of the Commune People's Committee decides to approve the policy and estimated funding for purchasing, repairing, renovating and upgrading assets and equipment with a maximum estimated budget of no more than 45 billion VND/task: a) Use of commune-level budget; b) Use targeted additional resources from the superior budget, after receiving written approval from the City People's Committee."
16	Article 3. 19	Article 4. Authority to decide on approval of policies and estimated funding for leasing goods and services	Commune People's Committee An Lao (Official Dispatch No. 1113/UBND-KT dated May 23, 2026)	It is recommended to consider and amend Article 4 as follows: “Authority to decide on approving policies and estimated funding for leasing goods and services as prescribed in Article 3 of this Resolution.	Accept and amend Article 4 as follows: “Authority to decide on approval of policies and estimated funding for leasing goods and services shall be implemented as prescribed in Article 3 of this Decision”.
20	Article 5. Authority to decide on approval of policies and estimated costs for performing the tasks of repair, renovation, upgrading, expansion, and new construction of work items in projects that have been invested in and constructed	Department of Health (Official Dispatch No. 5543/SYT-KHTC dated May 25, 2026)	It is recommended to study and adjust the provisions in Article 5 of the draft towards strengthening decentralization and decentralization of power to level I budgeting units in the city. Specifically, decentralize the Head of the city's level I estimating unit to approve policies and estimated costs for the tasks of repairing, renovating, upgrading, expanding, and building new construction items in projects that have been invested and built using the provincial budget, under the management scope of agencies, units, and affiliated units. (Similar to the decentralization content of Ho Chi Minh City in Decision No. 28/2026/QD-UBND dated May 15, 2026 stipulating the authority to decide on approval of policies and expected funding and expenses from regular state budget expenditures)	Remain as draft. Reason: Assessing the necessity of repair, upgrading, expansion, and new construction requires appraisal opinions on the project's condition from the specialized management agency, the Department of Construction, and the industry and field management expertise of many related agencies. Therefore, regulating the authority to approve policies and expected costs of tasks using the provincial budget will ensure the compatibility between needs and the ability to balance the city budget.
21	Article 5. Authority to decide on approval of policies and estimated costs for performing the tasks of repair, renovation, upgrading, expansion, and new construction of work items in projects that have been invested in and constructed	People's Committee of Kien Hung commune (Official Dispatch No. 1566/UBND-KT dated May 26, 2026)	To create proactive and timely resolution of urgent situations at the commune level in managing, operating and accelerating the disbursement of capital resources, it is recommended that the authorities consider decentralizing the tasks of using targeted additional sources from the superior budget to the commune-level budget to the commune level with the following contents: + Authority to decide on approval of policies and estimated costs for performing the tasks of repair, renovation, upgrading, expansion, and new construction of work items in projects that have been invested in construction from targeted additional sources from the superior budget with a value of < 1 billion VND.	Accept and amend Clause 2, Article 5 as follows: “2. The Chairman of the Commune People's Committee decides to approve the policy and estimated costs of repairing, renovating, upgrading, expanding, and building new work items in projects that have been invested in construction with an estimated maximum cost of not more than 20 billion VND/task: a) Use of commune-level budget; b) Use targeted additional resources from the superior budget, after receiving written approval from the City People's Committee».
22	Article 5. Authority to decide on approval of policies and estimated costs for performing the tasks of repair, renovation, upgrading, expansion, and new construction of work items in projects that have been invested in and constructed	Ward People's Committee Thanh Dong (Document No. 1214/UBND-KTHTĐT dated June 1, 2026)	It is proposed to amend Clause 2, Article 5 as follows: "The Chairman of the Commune People's Committee decides to approve the policy and estimated costs for repairing, renovating, upgrading, expanding, and building new work items in projects that have been invested and built using the commune-level budget, including targeted additional sources from the superior budget after receiving written approval from the City People's Committee, with the expectation that Cost up to 20 billion VND/task.”	Accept and amend Clause 2, Article 5 as follows: “2. 24	Article 5. Authority to decide on approval of policies and estimated costs for performing the tasks of repair, renovation, upgrading, expansion, and new construction of work items in projects that have been invested in and constructed	People's Committee of Nguyen Binh Khiem commune (Official Dispatch No. 964/UBND-KT dated May 21, 2026)	It is recommended to specifically guide the distinction between repair and renovation tasks using regular expenditures and tasks in the field of public investment to facilitate localities in the implementation process in Article 5.	The decision of the City People's Committee is a legal document detailing Decree No. 104/2026/ND-CP. Therefore, the Decision does not stipulate additional contents beyond the provisions of the original Decree. Guidance is provided during the implementation of the Decision.
25	Article 6. Authority to decide on approval of estimated costs for implementing planning activities	Hai Phong Economic Zone Management Board (Document No. 3170/BQL-QHXD dated June 6, 2026)	It is proposed to add Clause 3 to Article 6 of the draft Decision, specifically: "3. Hai Phong Economic Zone Management Board decides to approve and estimate costs for implementing planning activities for plans under approval authority or decentralized or authorized to approve according to regulations, helping the City People's Committee perform state management functions in economic zones and industrial parks in the city." The decentralization of authority to the Hai Phong Economic Zone Management Board will contribute specifically to the direction of the Chairman of the City People's Committee in Notice No. 240/TB-VP dated May 22, 2026; Enhance proactiveness, shorten implementation time of planning tasks within the scope of management, in accordance with assigned functions and tasks, improve proactiveness and responsibility, meet management requirements and develop economic zones and industrial parks in Hai Phong city.
