There will be no gaps in State management when the Law takes effect
According to the report of the Ministry of Planning and Investment - Standing agency of the Steering Committee at the Meeting, after the National Assembly gave comments on the draft Law at the 4th session, from January 2018 to present, the National Assembly's Law Committee (UBPL) has chaired and closely coordinated with the Ministry of Planning and Investment, the Ministry of Home Affairs and other Ministries, the Supreme People's Court, the Supreme People's Procuracy, and the People's Committees of the provinces: Quang Nam and Quang Nam. Ninh, Khanh Hoa and Kien Giang received and revised the draft Law according to the opinions of National Assembly delegates. The Politburo met and gave guidance on the local government organization model and land policy in the special zone. The National Assembly Standing Committee twice gave comments on the draft Law at the 20th and 23rd sessions. The Ministry of Planning and Investment has made 03 comments.It is necessary to report and seek opinions from the Prime Minister and the Government on the reception and revision of the draft Law to serve as a basis for coordinating with the verification agency to explain and receive opinions from National Assembly delegates and relevant agencies.
Up to now, the draft Law has been received and revised many times through meetings of the Standing Committee of the UBPL, UBPL, Committees of the National Assembly and the Conference of specialized National Assembly delegates and comments from ministries and branches. The draft Law, after revising and receiving the report of the National Assembly Standing Committee at the 23rd session, includes 6 Chapters, 84 Articles and 6 Appendices. Compared to the draft Law presented to the National Assembly at the 4th Session, 26 articles have been added and 29 articles removed, mainly moving the content to other articles to ensure more logic and reasonableness.
At the 23rd meeting of the National Assembly Committee on April 16, 2018, the majority of members of the National Assembly Committee assessed that the draft Law had been completed, accepted and revised many contents according to the opinions of National Assembly delegates and suggested continuing to study and review some contents. Based on the opinions of the National Assembly Standing Committee, the UBPL is currently urgently coordinating with the Ministry of Planning and Investment and relevant agencies to continue revising the draft Law to submit to the National Assembly for consideration and approval at the 5th session.
Regarding the development of legal documents guiding the implementation of the Law on Special Zones, according to the revised draft Law, the Government, the Prime Minister and relevant ministries, branches and agencies need to issue legal documents detailing and guiding the provisions of the Law. Specifically, the Government issued 01 Decree detailing and guiding the implementation of 18 articles of the Law; The Prime Minister promulgates regulations on 03 articles of the Law; Relevant ministries, branches and agencies promulgate documents and circulars guiding 09 articles.
In document No. 259/UBTVQH14-PL dated April 6, 2018, the National Assembly Standing Committee proposed documents detailing and guiding the implementation of the Law on special administrative and economic units after the Law is passed by the National Assembly, ensuring that it takes effect no later than the date the National Assembly's resolutions on the establishment of 03 special zones take effect. It is expected that the Law and Resolutions of the National Assembly establishing special zones will take effect from January 1, 2019.
Build institutions and policies that are not contrary to the Constitution, are superior, open, and have advantages for international competition
After listening to the opinions of members of the Steering Committee, Prime Minister Nguyen Xuan Phuc assigned the Ministry of Planning and Investment to preside over the acquisition and completion of the draft Law to submit to the National Assembly at the meeting next May. The spirit is not perfectionism, we must affirm the high determination of the Party, the National Assembly and the Government with a unified mindset, boldly building a breakthrough institution, creating a driving force for development for the 3 units, spreading to economic regions and the whole country, contributing to the country's rapid and sustainable economic development. Institutions and policies in special zones are not contrary to the Constitution, are superior, open, and have advantages for international competition. Policies must be consistent, stable and long-term. The Law Project updates the latest data, clearly identifies regional and international comparative advantages, and reviewsThoroughly evaluate short-term and long-term impacts, have an overall and strategic vision to plan policies to attract strategic investors.
In response to many opinions on investment incentives, finance, business lines, tax rates and deadlines, the Prime Minister proposed not to leave gaps in State management when the Law takes effect. It is necessary to continue to listen, select, absorb and complete the Law project and have a plan to receive and explain closely and convincingly about benefits and costs.
Prime Minister Nguyen Xuan Phuc requested that the organizational structure and staff work be carefully prepared so that when the Law takes effect, it can be operated immediately. Regulations on organizational structure towards streamlined, effective, efficient government with strong decentralization of authority in management. The Ministry of Home Affairs needs to clarify what work belongs to the Government and what work belongs to localities. Clearly define the organizational model, tasks, and specific authority of agencies, including the army, police, courts, procuracy, judgment enforcement, diplomacy, taxes, customs, State treasury... The Ministry of Planning and Investment makes an overall plan of the work that needs to be done, needs a roster, and reviews all the tasks that must be prepared so as not to miss work.
Emphasizing that these 3 special zones belong not only to the 3 provinces but to the whole country, Prime Minister Nguyen Xuan Phuc requested the 3 provinces to strictly rectify land management, forest management, and environmental management. Must ensure social order, not let "land brokers" and land buying and selling run amok in the area. At the same time, the Prime Minister also emphasized the role of propaganda and creating consensus in society./.
