Implementing the tasks assigned by the Prime Minister in Decision No. 857/QD-TTg promulgating a list and assigning agencies to preside over drafting documents detailing laws and resolutions passed by the National Assembly, the Ministry of Planning and Investment has presided over the development of 02 Decrees and 01 Circular to implement the Law on Cooperatives 2023, including a draft Decree regulating the registration of cooperative groups, cooperatives, and unions of cooperatives. cooperative.
In November 2023, the Ministry of Planning and Investment established a Drafting Board and Editorial Team to develop a Draft Decree on registration of cooperative groups, cooperatives, and cooperative unions. Members of the Drafting Board and Editorial Team are representatives of relevant ministries and branches, the Vietnam Cooperative Alliance, the State Bank and representatives of units under the Ministry of Planning and Investment.
Currently, the Ministry of Planning and Investment is seeking widespread comments from organizations and individuals nationwide on the draft Decree regulating the registration of cooperative groups, cooperatives, and cooperative unions. Implementing the instructions of the City People's Committee in Document No. 8326/VP-TC2 dated December 4, 2023, the Department of Finance is assigned to preside over comments on this Draft Decree.
The Draft Decree is designed to include 07 Chapters with 65 Articles, including: Chapter I: General regulations; Chapter II: Documents, order and procedures for registration of cooperatives and unions of cooperatives, registration of branch operations, representative offices, business locations of cooperatives and unions of cooperatives; Chapter III: Documents, order and procedures for registration of changes, notification of changes in registration content of cooperatives and cooperative unions; Chapter IV: Reorganization, suspension, dissolution, bankruptcy of cooperatives and cooperative unions; Chapter V: Registration of cooperative groups; Chapter VI: Registering cooperative groups, cooperatives, and cooperative unions in the electronic environment; Chapter VII: Implementation provisions.
The draft Decree was developed towards the following purposes:
– First, provide detailed and complete instructions and regulations on the registration of cooperative groups, cooperatives, cooperative unions, and cooperative development support funds assigned in the 2023 Law on Cooperatives to quickly bring the provisions of the Law to life;
– Second, regulations on business registration procedures for specific subjects specified in specialized legal documents such as the Law on Credit Institutions, Decree No. 45/2021/ND-CP;
– Third, continue to reform administrative procedures in the field of cooperative registration in the direction of cutting costs, time for implementing procedures, applying information technology, and sharing data between state management agencies.
