Article 36 of the Bidding Law No. 22/2023/QH15 dated June 23, 2023 stipulates that the investor or project preparation agency can base on the scale and nature of the project's bidding work to submit to the competent person for consideration and decision on organizing the preparation and approval of the master plan for contractor selection. The overall contractor selection plan is prepared simultaneously or independently of the feasibility study report and is approved after the feasibility study report is approved.
The overall contractor selection plan includes the following main contents:
– Consider the project implementation context for bidding work;
– Assess the investor's capacity, resources and experience in implementing the project's bidding activities;
– Analyze the market and identify risks in bidding;
– Specific objectives of bidding activities;
– Propose an overall plan for contractor selection for the project including: dividing the project into bidding packages; form and method of contractor selection; type of contract, principles of risk management division; progress of main tasks and bidding packages; Other contents that need to be noted in drafting bidding documents and managing contract implementation.
To ensure the implementation of the overall contractor selection plan according to the Bidding Law No. 22/2023/QH15, dated February 15, 2024, the Ministry of Planning and Investment issued Circular 01/2024/TT-BKHDT guiding the provision and posting of information on contractor selection and bidding document templates on the National Bidding Network System, which promulgates the preparation, submission, and approval forms. Appraise and approve the overall contractor selection plan. The overall contractor selection plan is a new point of Bidding Law No. 22/2023/QH15 compared to previous regulations on bidding.
The contractor selection master plan is an important tool to ensure the bidding process takes place in a planned and effective manner, helping the investor or project preparation agency ensure that contractor selection decisions are made based on information and careful analysis.
