On October 13, 2015, the Government issued Decree No. 91/2015/ND-CP on state capital investment in enterprises and the management and use of capital and assets in enterprises. This Decree regulates state capital investment in enterprises; financial management for state-owned enterprises and management of state capital invested in joint-stock companies and limited liability companies with two or more members.
The subjects of application of this Decree include: One-member limited liability companies in which the State holds 100% of the charter capital, which are parent companies of state economic groups, parent companies of state corporations, parent companies in parent-subsidiary company groups; Independent one-member limited liability companies in which the State holds 100% of the charter capital; representatives of state capital invested in joint-stock companies and limited liability companies with two or more members; other agencies, organizations, and individuals related to the investment, management, and use of capital and assets in state-owned enterprises.
This Decree takes effect from December 1, 2015, replacing Decree No. 71/2013/ND-CP dated July 11, 2013, of the Government on state capital investment in enterprises and financial management for enterprises in which the State holds 100% of the charter capital; Decree No. 09/2009/ND-CP dated February 5, 2009, of the Government on promulgating regulations on financial management of state-owned companies and management of state capital invested in other enterprises; and regulations on financial management for one-member limited liability companies owned by the state in Decree No. 25/2010/ND-CP dated March 19, 2010, of the Government.
