a) Execution order:
– Step 1: The foreign investor in the BCC contract submits an application to establish an executive office at the Department of Finance where the executive office is expected to be located.
– Step 2: Within 15 days from the date of receiving the dossier, the Department of Finance issues a Certificate of registration of operating office operations to the foreign investor in the BCC contract.
b) How to do it:
– Directly at the administrative agency headquarters.
– Through the public postal service.
c) Profile components:
– The registration document to establish an executive office includes: name and address of representative office in Vietnam (if any) of the foreign investor in the BCC contract; name and address of executive office; content, duration, and scope of operations of the executive office; Full name, place of residence, ID card number, Citizen Identification card or Passport number of the head of the executive office;
– The decision of the foreign investor in the BCC contract on the establishment of an executive office;
– Copy of the decision to appoint the head of the executive office;
– Copy of BCC contract.
d) Number of documents: 01 set of documents.
đ) Resolution deadline:
Within 15 days from the date of receiving the dossier, the Department of Finance shall issue a Certificate of registration for operating office operations to the foreign investor in the BCC contract.
e) Implementing agency:
The Department of Finance where the executive office is expected to be located shall issue the Executive Office Operation Registration Certificate to the foreign investor in the BCC contract.
g) Subjects carrying out administrative procedures:
– Foreign investors.
h) Results of implementing administrative procedures:
Certificate of registration of executive office operations according to Form A.II.12 issued with Circular No. 03/2021/TT-BKHDT.

Document for registration of establishment of an executive office of a foreign investor in a business cooperation contract according to Form A.I.8 issued with Circular No. 03/2021/TT-BKHDT.
l) Requirements and conditions for performing the procedure:
The BCC contract is signed between a domestic investor and a foreign investor or between foreign investors carrying out procedures for granting an Investment Registration Certificate as prescribed in Article 38 of the Investment Law.

– Circular No. 03/2021/TT-BKHDT dated April 9, 2021;
