Pursuant to Clause 3, Article 82 of Decree No. 168/2025/NĐ-CP, households engaged in agricultural, forestry, fishery production, salt production, and individuals who are street vendors, snack vendors, itinerant traders, mobile businesses, seasonal businesses, or service providers with low income are not required to register as business households, except for cases involving conditional business lines and sectors. The Provincial People's Committees and People's Committees of centrally-run cities shall stipulate the low-income threshold applicable within their respective localities.

The People's Committees of provinces and centrally-run cities shall stipulate the low-income threshold applicable within their localities.
Mr. Pham Tuan Khai inquired how the aforementioned regulation should be understood among the following interpretations:
(1) Households engaged in agriculture, forestry, fisheries, salt production, and street vendors, snack sellers, itinerant traders, mobile businesses, seasonal businesses, service providers, where these activities all require a low-income threshold as per the Decision of the People's Committee, will not need to register as business households;
(2) Only services with low income as per the Decision of the People's Committee, and households engaged in agriculture, forestry, fisheries, salt production, street vendors, snack sellers, itinerant traders, mobile businesses, seasonal businesses (without distinguishing between large/small scale, revenue levels, etc.), are all not required to register as business households.
Regarding this matter, the Ministry of Finance offers the following opinion:
Pursuant to Clause 3, Article 82 of Decree No. 168/2025/NĐ-CP dated June 30, 2025, of the Government on enterprise registration, households engaged in agriculture, forestry, fisheries, salt production, and street vendors, snack sellers, itinerant traders, mobile businesses, seasonal businesses, service providers with low income are not required to register as business households, except for cases involving business lines and sectors subject to conditional business investment; the People's Committees of provinces and centrally-run cities shall stipulate the low-income threshold applicable within their localities.
Based on the aforementioned regulation, households engaged in agriculture, forestry, fisheries, salt production, and street vendors, snack sellers, itinerant traders, mobile businesses, seasonal businesses, service providers whose income meets the low-income threshold stipulated by the People's Committees of provinces and centrally-run cities are not required to register as business households, except for cases involving business lines and sectors subject to conditional business investment.
