After the 2023 Cooperative Law and Decree 113/2024/ND-CP dated September 12, 2024 of the Government detailing a number of articles of the Cooperative Law took effect, Circular No. 01/2020/TT-BKHDT dated February 19, 2020 on guiding the classification and evaluation of Cooperatives has a number of regulations. The regulations are no longer consistent with the newly promulgated legal documents mentioned above. Therefore, reviewing and evaluating the implementation of Circular No. 01/2020/TT-BKHDT dated February 19, 2020 on guiding the classification and evaluation of Cooperatives in practice in the city to advise and propose the Ministry of Planning and Investment to research and amend is very important, ensuring state management activities on Cooperatives are carried out effectively.
Currently in Hai Phong city there are 417 cooperatives, of which 301 cooperatives (hereinafter referred to as cooperatives) comply and submit the annual evaluation sheet according to regulations, accounting for 72.18%. The self-assessment and classification of cooperatives helps the cooperative clearly determine the financial situation, human resources and operating capacity of the cooperative, thereby drawing out the strengths and limitations in order to build appropriate plans to consolidate and promote the advantages and overcome the limitations of the cooperative to promote the development of the cooperative's production and business situation. At the same time, through synthesizing and reporting the assessment results of cooperatives according to Article 9 of Circular No. 01/2020/TT-BKHDT, it has helped state management agencies grasp and remove difficulties for cooperatives during the process.investment, production and business; Implement tasks and solutions to promote production and business in the coming time; At the same time, honor and reward typical cooperatives that have contributed to the socio-economic development of the district.
However, the implementation and application of Circular No. 01/2020/TT-BKHDT in practice still faces some difficulties and obstacles as follows:
+ Internal resources in terms of capital, facilities, equipment; The limited level of technology, ability to access market information, etc. of many cooperatives has greatly affected production and business activities, especially in the new conditions of switching to a market mechanism and implementing production and business cooperation. The capacity level of the management and administration apparatus of most cooperatives is still inadequate compared to the new management mechanism because the management staff operates mainly based on practical experience and has not received basic training; Lack of qualified and experienced staff, unable to meet the market's innovation requirements.
+ Many cooperatives have not determined the direction for long-term production and business development, their operations are only short-term; Production and business development has not been oriented to suit the market mechanism and bring high economic efficiency. Many cooperatives operate with low efficiency and losses; roles and positions are reduced.
+ Most cooperatives are mainly doing service business but their scale of operation is
Small, monotonous, fragmented activities, little business capital, no access to capital
Preferential loans lead to capital shortage; Many cooperatives do not have headquarters locations, and warehouses to store goods do not exist. Besides, the state's preferential policies such as land policy, credit, trade promotion activities, support for infrastructure investment... have not been implemented. Therefore, investment and application of new science and technology in production, business and services still have many limitations and difficulties.
+ Many cooperatives, especially small cooperatives, do not have a complete accounting system and do not clearly understand financial data. This makes gathering information for assessment difficult and inaccurate.
+ Some cooperatives are not clearly aware of the importance of classification and evaluation, leading to slow provision of information or lack of information, affecting the evaluation process.
+ According to Circular No. 01/2020/TT-BKHDT, Articles 3, 4, 5, 6 stipulate that cooperatives are classified as follows: according to products and services provided to members, according to member size, according to the size of total capital, and by industry. However, based on the 2020 Law on Cooperatives, Decree No. 113/2024/ND-CP dated June 12, 2024 detailing a number of articles of the Law on Cooperatives, Articles 4 and 5 stipulate that cooperatives are classified as follows: fields of activity and criteria for classifying cooperatives, classifying cooperative sizes. Therefore, the classification criteria in Circular No. 01/2020/TT-BKHDT are no longer appropriate according to the 2023 Law on Cooperatives and cause inadequacies in management.
Based on the above review content, Hai Phong City Business Registration Office has reported and proposed to the Ministry of Planning and Investment to study and amend in the near future.
