Amending a number of articles of the Regulations on the management and use of non-refundable aid not falling under official development assistance from foreign agencies, organizations, and individuals for Vietnam in Hai Phong City, issued together with Decision No. 61/2026/QD-UBND dated July 22, 2026, of the City People's Committee

Pursuant to the Law on Organization of Local Government No. 72/2025/QH15;

Pursuant to the Law on Promulgation of Legal Normative Documents No. 64/2025/QH15, amended and supplemented by Law No. 87/2025/QH15;

Pursuant to Decree No. 187/2025/ND-CP dated July 1, 2025, amending and supplementing a number of articles of Decree No. 78/2025/ND-CP dated April 1, 2025, of the Government detailing a number of articles and measures to organize and guide the implementation of the law on promulgation of legal normative documents and Decree No. 79/2025/ND-CP dated April 1, 2025, of the Government on inspection, review, systematization, and handling of legal normative documents;

Pursuant to Decree No. 313/2025/ND-CP dated December 8, 2025, of the Government on the management and use of non-refundable aid not falling under official development assistance from foreign agencies, organizations, and individuals for Vietnam;

Pursuant to Decision No. 192/2025/QD-UBND dated October 17, 2025, of the City People's Committee on the promulgation of regulations on the formulation and promulgation of legal normative documents of Hai Phong City;

Pursuant to Decision No. 61/2026/QD-UBND dated July 22, 2026, of the City People's Committee on the promulgation of the Regulations on the management and use of non-refundable aid not falling under official development assistance from foreign agencies, organizations, and individuals for Vietnam in Hai Phong City.

At the proposal of the Director of the Department of Finance in Official Letter No. .../TTr-STC dated .../.../2026;

The City People's Committee issues a Decision amending a number of articles of the Regulations on the management and use of non-refundable aid not falling under official development assistance from foreign agencies, organizations, and individuals for Vietnam in Hai Phong City, issued together with Decision No. 61/2026/QD-UBND dated July 22, 2026, of the City People's Committee.

Article 1. Amendment to Article 8

1. Point b, Clause 1, Article 8 is amended as follows:
   "b) For cases where the aid is not eligible for reception, the City People's Committee shall notify the aid provider of the decision not to receive the aid."
2. Point a, Clause 8, Article 8 is amended as follows:
   "a) Establish a Project Management Board for projects with an aid capital scale of over 300,000 US dollars to assist the aid owner or project owner in managing the implementation of one or more programs or projects. The Project Management Board represents the project owner, is responsible to the project owner, the managing agency, and before the law for its decisions."
3. Clause 7, Article 8 is amended as follows: Amend "State Treasury Region VIII" to "State Treasury Region III".

Article 2. Effectiveness and Implementation

1. This Decision shall take effect from the date... month... year 2026.
2. The Chief of the Office of the City People's Committee; Directors of the Departments of Finance, Home Affairs, Foreign Affairs, Justice, Science and Technology; Chairpersons of the People's Committees of communes, wards, special zones; and heads of relevant agencies, organizations, and individuals are responsible for implementing this Decision./.
