Pursuant to Law No. 56/2024/QH15 dated November 29, 2024 amending and supplementing a number of Articles of the Securities Law, Accounting Law, Independent Audit Law, State Budget Law, Law on Management and Use of Public Assets, Tax Administration Law, Personal Income Tax Law, National Reserve Law, Law on Handling of Administrative Violations;

Pursuant to Law No. 57/2024/QH15 dated November 29, 2024 amending and supplementing a number of Articles of the Planning Law, Investment Law, Investment Law by public-private partnership method and Bidding Law;

Pursuant to Resolution No. 76/2025/UBTVQH15 dated April 14, 2025 of the National Assembly Standing Committee on the arrangement of administrative units in 2025;

Pursuant to Decree No. 24/2024/ND-CP dated February 27, 2024 of the Government detailing a number of articles and measures to implement the Bidding Law on contractor selection;

Pursuant to Decree No. 73/2019/ND-CP dated September 5, 2019 of the Government regulating investment management in information technology application using state budget capital;

Pursuant to Decree No. 82/2024/ND-CP dated July 10, 2024 of the Government amending and supplementing a number of articles of Decree No. 73/2019/ND-CP dated September 5, 2019 of the Government regulating investment management in information technology application using state budget capital;

Pursuant to Decree No. 115/2024/ND-CP dated September 16, 2024 of the Government detailing a number of articles and measures to implement the Bidding Law on selecting investors to implement investment projects using land;

Pursuant to Decree No. 78/2025/ND-CP dated April 1, 2025 of the Government detailing a number of articles and measures to organize and guide the implementation of the Law on Promulgation of Legal Documents;

Considering Proposal No. …/TTr-UBND dated … month … 2025 of the City People's Committee on promulgating a Resolution amending and supplementing a number of articles of Resolution No. 12/2024/NQ-HDND dated November 11, 2024 of the City People's Council stipulating the authority to decide on the procurement of goods, services and investment and procurement of information technology application activities; Verification report No. .../BC-KTNS dated ... month ... 2025 of the Economic - Budget Committee, City People's Council; Discussion opinions of delegates of the City People's Council at the meeting;

The City People's Council issued a Resolution amending and supplementing a number of articles of Resolution No. 12/2024/NQ-HDND dated November 11, 2024 stipulating the authority to decide on the procurement of goods and services and investment and procurement of information technology application activities.

Article 1. Samend and supplement a number of articles of Resolution No. 12/2024/NQ-HDND dated November 11, 2024 of the City People's Council on regulations on authority to decide on procurement of goods, services and investment and procurement of information technology application activities, specifically as follows: after:

1. Amend and supplement a number of clauses of Article 3 as follows:
2. a) Amend and supplement clause 3 as follows:

“3. Commune-level People's Committees decide to purchase goods and services of their own units and of organizations and units using the commune-level budget with an estimated value of over 200 million VND to 15 billion VND."

1. b) Amend and supplement clause 4 as follows:

“4. Estimating units that directly use the provincial budget decide to purchase goods and services with an estimated value of over 200 million VND to 01 billion VND.”

2. Amend and supplement Clause 3, Article 4 as follows:

“3. Commune-level People's Committees decide to purchase goods and services of their own units and of organizations, units and individuals using science and technology funding from the commune-level budget with an estimated value from over 01 billion VND to 15 billion VND."

3. Amend and supplement a number of clauses of Article 5 as follows:
4. a) Amend clause 2 as follows:

“2. The Department of Science and Technology decides on investment and procurement of its own agency and other agencies, organizations and units using local budget with total investment, estimated value from over 07 billion VND to 15 billion VND.”

1. b) Amend and supplement clause 4 as follows:

“4. The Commune People's Committee decides on investment and procurement using the commune-level budget with a total investment, estimated value of up to 07 billion VND."

Article 2. Replace the phrase "city-level budget" with the phrase "provincial-level budget" in Clause 2, Article 3, Clause 2, Article 4 and Clause 3, Article 5 of Resolution No. 12/2024/NQ-HDND dated November 11, 2024 of the City People's Council.

Article 3. Implementation organization

1. Assign the City People's Committee to direct the implementation of the Resolution.
2. Assign the Standing Committee of the City People's Council, Committees of the City People's Council, Delegate Groups of the City People's Council, and delegates of the City People's Council to supervise the implementation of the Resolution.
